I have a trumpet on Craigslist (it's also here, but interest has been nil)

I got the following response from a potential buyer, or a possible scammer:

Is this a local craigslist? I always pay cash on sight with local craigslist.

No, not local. I have bought things from remote CL's, but the 2nd email makes it seem more like a scam.

Did you ask for a money order drawn on either USPS or Wal-Mart? Those are both guaranteed funds.

Who sends a "mover" to pick up a horn?

I was tempted to have the check delivered to my PO box (it also has a street address) and just not be there when Bruno arrived to pick up the horn.

I could ask for a personal check - in California a bounced check can be worth 3 times the amount in small claims court. Default judgement when the defendant doesn't show up.

But it's not worth my effort. He (or she) will move on to an easier mark.

I may be incorrect, but even if you won a judgment, you still have to collect on it, if the guy doesn't show up I doubt you ever would. I'm pretty sure that unless you know where his bank account is, you're out of luck.

I dont see a scam. A scam is theft and this guy will wait until the check clears before taking the goods.

Scams work the other way round, they give a bad check and take the goods, then the cheque bounces.

A cleared check cannot bounce, he is paying in advance for goods which he collects after the payment is made. There is no possibility of theft as I read it.

It's hard to define when a check "clears" in the 21st century. A check can be paid out, and then found later to be fraudulent. The person who cashed the check is still responsible, and will have to return the money or face possible prosecution for cashing a bad check. This is how this scam and its close relatives work; hoping that the seller's bank will accept the check, and the merchandise will be sent (or even better, picked up by the "mover") before the scam is discovered by the bank

Craig's List has a warning right on their site to not engage in any deals that are not face-to-face, and preferably somewhere safe like a Starbucks, bank, what have you. Someplace with video out the wazoo is I think what they mean, and other people around.
